What is the procedure for residence permits?

From the moment the candidate arrives in the country, he can already start working in the company based on the work permit and the employment procedures can already be done: occupational medicine and the individual employment contract.

In order to be able to apply for a work permit, a series of documents are required which we will send you by email before the arrival of the candidates. Based on these, we will make the online applications on the immigration portal and let you know when the appointment has been set at the counter to meet with the candidates. They must be informed that they will be photographed and fingerprinted.

How long is the residence permit issued?
According to the law, the residence permit is obtained within 30 days from the date on which the candidate presented himself at the counter and his file was accepted, his photos were taken and his fingerprints were taken.
Who can pick up the residence permit?
Candidate can collect the permit directly based on their passport and registration slip from the counter. Also, the employer can pick up the candidate's residence permit based on a notarial power of attorney signed by both parties and the registration slip at the counter.
How long do we have to apply for permits?
To avoid penalties, the permit file must be submitted at the counter no later than 30 days before the expiration of the 90-day period since the applicant obtained the Asian visa. This date appears on the passport and the remaining time can be calculated.
What is the validity of a residence permit?
For candidates who have arrived in Romania for the first time, the residence permit is valid for one year. If it is desired to continue the contract, the request for the new permit is made a maximum of 30 days before the expiration of the previous one and the same documents are prepared as when they arrived in Romania.

The employment contract according to Romanian legislation

When is the individual employment contract (CIM) drawn up?
From a legal point of view, candidates can start working starting from the second day after they arrived in Romania. The CIM is drawn up based on the data from the passport, and in REVISAL there is the option to select "Other documents of the employee" in the absence of a CNP, to allow you to complete the candidate's registration process in the system.
Will they be employed as Romanian employees or are there other distinct conditions?
Candidates will be employed as Romanian employees and the same procedure will be followed according to Romanian law.
In the absence of a CNP, how to fill out form 112?
This process differs from company to company and depends on the internal organization of each one.
How to register in CHARISMA without a CNP?
Each company has its own salary system that may differ from one to another. We recommend that you discuss viable options in accounting or call the support department of the firm that offered you the payroll program.
Can I assign candidates to a position other than the one I applied for?
Not. The applicant will not have their permit application accepted and will have to leave the country at the end of the 90-day period they obtained the visa.
What is the solution for employment on a different COR position than the one for which approval has already been requested and obtained?
After obtaining the candidate's residence permit, a new work permit is requested, and upon obtaining it, a request is made to update the residence permit. All of these involve new taxes that will be borne by the employer, and the legal deadline for obtaining each of them is 30 days.
How to proceed in the case of disciplinary violations?

In the case of violations, the procedure is the same as for any Romanian employee. It is important to make them very clearly aware of the specifications from the company's Internal Order Regulations (delays, unexcused absences, etc.) from the beginning.

How to proceed with Medical Leave/Rest Leave/Leave without pay?
On the basis of CIM and taxes paid to the state, candidates benefit from medical insurance and can apply for medical leaves in case of health problems.

There are no tax advantages for those of you who wish to employ foreign nationals.

Although we would like you to avoid bankruptcy, force majeure situations can occur. The pandemic has also prepared us for such situations. Because Asian workers' work visas and residence permits are valid for 2 years, if the employment contracts have force majeure clauses and these unforeseen situations occur before their expiration, if you ask for our help, we will try to place the workers to other employers.

Payment for recruitment service

How is the payment for the recruitment service made?
Payment for the recruitment process is made in 4 installments: Tranche 1 – at the time of signing the contract, when the recruitment process begins Tranche 2 – at the time of obtaining work permits in Romania Tranche 3 – when travel visas are issued The last installment – ​​when we bring you the workers.
Can the costs be negotiated?
There is no single price in the market, our offers are customized and negotiated. The quality/price ratio is also important (stability, safety, extended working hours, reliability). The cost of the documents is a standard one, money that goes to the local authorities (Work Permit, Residence Permit).

Recruitment process

Why does it take 3-4 months to bring in workers?

The process of bringing in Asian workers is a very complex one, and the 3-4 month time of bringing in from selection is due to legal, necessary and mandatory procedures, but it is often worth the wait. We have solutions in this chapter as well!

Recruitment must be done carefully and correctly, in order to deliver the best quality, according to the job description and according to what we find in Asia. For this process we need between a week and a month, depending on the qualification and the financial offer of the employer.

The preparation of the work permit takes between 1 and 2 months at the local authorities, and the work visa takes between 2 weeks and 2 months, depending on the Asians' country of origin.

If they don't know how to do what they were recruited for or can't cope?
We only recruit candidates who have worked in related industries, we inform candidates in advance about the activity they will carry out in Romania, the program and all other necessary aspects. We test them if necessary, either online or we go to the site if the situation requires it (a large number of employees). The interview can also be done online, and the employer can make the selection based on these real-time or recorded interviews.
Who picks up applicants at the airport?
One of our representatives will be at the airport to liaise with immigration and complete the entry procedures for candidates. The employer must send a person in charge to pick up the candidates and ensure their transportation to the location where they will be accommodated.
What do Asians eat?
Asians eat mostly rice-based dishes. We recommend that in the first few days, until they get used to its location, you talk to them directly and get them the specific ingredients. After 2-3 days they will be able to cook for themselves. Meal vouchers can also be provided. You can provide them with a kitchen equipped with all the necessary utensils, they can cook their own dishes that they are used to.
When they come to the country do they have money with them?
It is possible to come with 10-20 Euro to them, but if you want to help them, you can give them an advance from their salary so that they can manage until payday.
Do they have minimum hygiene kit with them?
Most candidates are informed by the agency in Asia to have a strict supply of hygiene items, clothing, etc. If they inform you that they need certain items, you can ask a driver to go with them, show them the surroundings, the shops. It is normal that at first there will be some reluctance because they do not know the area, but after they get used to it they can go and buy the things they need by themselves and they will no longer need your guidance.
How do Asians dress?
Just like us. The only difference is that their country is much warmer than ours in winter, this depends on the region the candidate comes from. Our recommendation is that, if they find it more difficult to adapt to the temperatures in Romania, you should get them work uniforms or give them the opportunity to go somewhere to buy thicker clothes.
How do we get along with them?

Most candidates know English and you can communicate with them that way. If there is a situation where you do not get along with a candidate, you can always download voice translation programs from the Internet.

The role of the employer in the recruitment process

What is my role as an employer in the recruitment process?

Even if the most bureaucratic part falls on our shoulders, we will need a little help from you as an employer: We do the recruiting, but you have the final say on the selection side, either on the basis of a recorded interview or a live interview directly with potential workers.

We need assistance with contracts and power of attorney for submitting work permits and obtaining visas and residence permits. And last but not least, we will be able to collaborate on the logistics side (accommodation and meals) as well as the process of induction and adaptation to the culture.

Delegations or leaving the company

What do I do if a candidate decides to leave?
According to the law, the employer has the obligation to notify the General Inspectorate for Immigration of any arrival or departure of foreign employees, whether they decide to go to another company, whether they go on leave at home, etc. Be very careful if you change their place of accommodation/the position they are employed in, in this case the residence permit must also be changed.
What do we do if a candidate behaves violently?
Any act that contravenes the law is reported to the Police/General Inspectorate for Immigration and will be sanctioned according to the law.
Can I delegate them to another work point?
Yes, candidates can be delegated according to Romanian law and registrations are made in REVISAL in this regard. If this happens over a longer period of time, immigration must be notified and, depending on the case, residence permits renewed.
Can I keep their passports/permits?
According to the law, the employer has no right to withhold the identification documents of the employee.
